Since 2005 California native Amine Nehme has owed money to the Venetian Casino in Las Vegas. The blackjack player used bad judgment to sign for a credit line of $500,000. Nehme lost the entire amount and the casino was unable to collect as the player had insufficient funds in his account. The casino has tried to get the money for years and just recently they finished up in court and will not be paid. After Nehme lost the money the casino tried to collect but found that Nehme did not have the money in his account. The gambler was sued in 2007 and in 2008 Brian Sandoval the US district Court judge did not allow evidence that Nehme terminated his credit line during a seven month period before he asked for the marker. The Judge went a step further and gave a summary judgment in favor of the casino.
An appeal took place and Gary Logan the attorney for Nehme argued that the player paid off a $1.5 million marker before he asked for the termination of his credit line. Logan also stated that the player paid every obligation he owed. He said it was the duty of the casino to cancel his credit line and they did not do that. The judge did not allow that information to be placed in evidence.
Judge Carlos Bea heard the appeal and he ruled: “the district court’s improper exclusion of the ….letter and return receipt was harmful because those pieces of evidence raise a triable issue of fact as to whether Venetian’s right to enforce the marker against Nehme is subject to Nehme’s defense based on common law contract principles.” So the case is now over and the Venetian did not earn the $500,000 marker back.
