Anyone can walk into a casino and count cards as it is not illegal but casinos in most areas have the right to ban a customer from playing at their casino if they are caught counting cards at the blackjack tables. In Indiana there is a law that allows card counters to continue to play at casinos. Indiana casino operators are appealing to a lower court to change that ruling. The casinos have stated this is an unfair advantage even though the techniques to count cards are legal. Many believe that if the court does not overturn the ruling that Indiana casinos will begin to change the rules of blackjack.
Legal Analyst Bob Brice commented: “This is going to be a landmark decision by the Indiana Supreme Court, and most likely it is not going to be a decision that casinos like. The law is clearly in the favor of the card counters.”
Thomas Donovan started this case as he was thrown out of an Indiana casino and brought a lawsuit against the Grand Victoria casino. Donovan lost his initial case but then he appealed and won. Donovan is an admitted card reader. Casinos want to be able to ban a player that counts cards instead of allowing them to continue to play.
