Thomas P. Donovan was banned from the Grand Victoria Casino and Resort for counting cards at the blackjack table. Donovan started a court case against the casino to win back the right to visit the casino and gamble. Donovan raised the question: Must a casino allow a self-described professional blackjack card counter play? Donovan’s lawyer argues that the Grand Victoria as well as the state does not have any rules banning such a practice. Because of this Donovan cannot be banned from the casino.
The lawyer for the Grand Victoria argues that the casino is a privately owned company and therefore they can choose not to do business with patrons for any given reason. On Wednesday, Donovan’s case was heard by three judges at the Indian Court of Appeals at the Indiana University Southeast in New Albany. Unusual cases of interest in the community usually end up outside of the courts headquarters.
The court case drew a crowd of more than 300 students, casino representatives as well as four judges from local courts. Judge L. Mark Bailey who was one of the judges presiding over the case said a ruling could come in about two months.
